Terms of Use Welcome to the BOS Web site (the "Site"). By using the Site, you agree to follow these terms and conditions concerning your use of the Site ("Terms of Use") and our Privacy Policy. We may revise the Terms of Use and Privacy Policy at any time without notice.

1. Use of Web Site Information.
You may download, view, copy and print documents (the "Documents") and from the Site subject to the following: (a) the Documents may be used solely for personal or informational purposes, or to facilitate business transactions for BOS; and (b) the Documents may not be modified or altered in any way unless approved of by BOS in writing. Except where your use constitutes "fair use" under copyright law, you may not otherwise use, download, upload, copy, print, display, perform, reproduce, publish, license, reuse, post, transmit or distribute any information from this Web site in whole or in part without the express authorization of BOS. 2.Prohibited Content and Activity:
Prohibited Content includes, but is not limited to, Content that, in the sole discretion of BOS:

  1. Is patently offensive;
  2. Harasses or advocates harassment of another person;
  3. Using the account, username, or password of another Member at any time or disclosing your password to any third party or permitting any third party to access your account;
  4. Impersonating or attempting to impersonate another Member, person or entity;
  5. Publicly posts information that poses or creates a privacy or security risk to any person;
  6. Constitutes or promotes information that you know is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;
  7. Constitutes or promotes an illegal or unauthorized copy of another person's copyrighted work,
  8. Includes a photograph or video of another person that you have posted without that person's consent;
  9. Violates the privacy rights, publicity rights, copyrights, trademark rights, contract rights or any other rights of any person.
  10. Using the BOS Site & or Services in a manner inconsistent with any and all applicable laws and regulations.

4. Content Posted
You are solely responsible for the Content that you post on or through any of the BOS Services, and any material or information that you transmit to other Members and for your interactions with other Users.

BOS may reject, refuse to post or delete any Content for any or no reason, including Content that in the sole judgment of BOS violates this Agreement or which may be offensive, illegal or violate the rights of any person or entity, or harm or threaten the safety of any person or entity. BOS assumes no responsibility for monitoring the BOS Services for inappropriate Content or conduct. If at any time BOS chooses, in its sole discretion, to monitor the BOS Services, BOS nonetheless assumes no responsibility for the Content, no obligation to modify or remove any inappropriate Content, and no responsibility for the conduct of the User submitting any such Content


5. Protecting Copyrights and Other Intellectual Property:
The BOS respects the intellectual property of others, and requires that our users do the same. You may not upload, embed, post, email, transmit or otherwise make available any material that infringes any copyright, patent, trademark, trade secret or other proprietary rights of any person or entity. The BOS has the right to terminate the Membership of infringers.

6. Member Disputes:
You are solely responsible for your interactions with other BOS Members. BOS reserves the right, but has no obligation, to become involved in any way with disputes between you and other Members.

7. Use of Online Management Tools
This site contains Online Management Tools such as lead submission forms, commission calculators etc. Any use of software based Online Management Tools and accompanying documentation you download from the Site are subject to the terms of an Agent Agreement between you and BOS. You must read the Agent Agreement and indicate your agreement to its terms prior to accessing the Online Management Tools. All rights, title and interest not expressly granted are reserved.

8. Passwords and Security
You are responsible for maintaining the confidentiality of any password(s) you are given to access the Site, and are fully responsible for all activities that occur under your password(s). You agree to notify BOS immediately of any unauthorized use of your password(s).
BOS is concerned about the security of personal information we have collected from you and we have taken reasonable steps to prevent unauthorized access to that information. Only the Person assigned an online account may login and use said account, accounts are not to be shared at any time for any reason.

9. Privacy Policy
BOS is concerned about your privacy and has developed a policy to address privacy concerns. Please email us for a copy of our privacy policy.

10. Termination of Use
You agree that BOS may, in its sole discretion, at any time terminate your access to the Site and any account(s) you may have in connection with the Site. Access to the Site may be monitored by BOS.
 
11. Third Party Web Sites, Content, Products and Services
The Site provides links to Web sites and access to content, products and services from third parties, including users, advertisers, affiliates and sponsors of the Site. You agree that BOS is not responsible for the availability of, and content provided on, third party Web sites. BOS RECOMMENDS THAT YOU REVIEW THE PRIVACY POLICIES OF OTHER THIRD PARTY SITES BEFORE YOU USE THEM. You agree that BOS is not responsible for third party content accessible through the Site, including opinions, advice, statements and advertisements, and understand that you bear all risks associated with the use of such content. If you choose to purchase any products or services from a third party, your relationship is directly with the third party. You agree that BOS is not responsible for: (a) the quality of third party products or services; and (b) fulfilling any of the terms of your agreement with the seller, including delivery of products or services and warranty obligations related to purchased products or services. You agree that BOS is not responsible for any loss or damage of any sort you may incur from dealing with any third party.

12. Disclaimer
BOS DEVELOPS SOLUTIONS ON A "BEST EFFORT" BASIS.
EXCEPT WHERE EXPRESSLY PROVIDED OTHERWISE, THE SITE, AND ALL CONTENT, MATERIALS, INFORMATION, SOFTWARE, PRODUCTS AND SERVICES PROVIDED ON THE SITE, ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. BOS EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANT ABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. BOS MAKES NO WARRANTY THAT: (A) THE SITE WILL MEET YOUR REQUIREMENTS; (B) THE SITE WILL BE AVAILABLE ON AN UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE BASIS; (C) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SITE OR ANY SERVICES OFFERED THROUGH THE SITE WILL BE ACCURATE OR RELIABLE; OR (D) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SITE WILL MEET YOUR EXPECTATIONS.

BOS RESERVES THE RIGHT TO MAKE CHANGES OR UPDATES TO THE SITE AT ANY TIME WITHOUT NOTICE.

13.. Limitation of Liability
IN NO EVENT SHALL BOS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA OR USE, INCURRED BY YOU OR ANY THIRD PARTY, WHETHER IN AN ACTION IN CONTRACT OR TORT, ARISING FROM YOUR ACCESS TO, OR USE OF, THE SITE.

15. Disputes. The Agreement shall be governed by, and construed in accordance with, the laws of the State of Georgia, without regard to its conflict of law provisions. You and BOS agree to submit to the exclusive jurisdiction of the courts located within the State of Georgia to resolve any dispute arising out of the Agreement or the BOS Site and Services. EACH OF THE PARTIES HEREBY KNOWINGLY, VOLUNTARILY AND INTENTIONALLY WAIVES ANY RIGHT IT MAY HAVE TO A TRIAL BY JURY IN RESPECT OF ANY LITIGATION (INCLUDING BUT NOT LIMITED TO ANY CLAIMS, COUNTERCLAIMS, CROSS-CLAIMS, OR THIRD PARTY CLAIMS) ARISING OUT OF, UNDER OR IN CONNECTION WITH THIS AGREEMENT. FURTHER, EACH PARTY HERETO CERTIFIES THAT NO REPRESENTATIVE OR AGENT OF EITHER PARTY HAS REPRESENTED, EXPRESSLY OR OTHERWISE, THAT SUCH PARTY WOULD NOT IN THE EVENT OF SUCH LITIGATION, SEEK TO ENFORCE THIS WAIVER OF RIGHT TO JURY TRIAL PROVISION. EACH OF THE PARTIES ACKNOWLEDGES THAT THIS SECTION IS A MATERIAL INDUCEMENT FOR THE OTHER PARTY ENTERING INTO THIS
AGREEMENT

Indemnity.
You agree to indemnify and hold BOS its subsidiaries, and affiliates, and their respective officers, agents, partners and employees, volunteers, contractors and sub-contractors harmless from any loss, liability, claim, or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the BOS Services in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of your representations and warranties set forth in this Agreement and/or if any Content that you post on or through the BOS Services causes BOS to be liable to another.

Other.
This Agreement is accepted upon your use of the BOS Website or any of the BOS Services and is further affirmed by you becoming a Member. This Agreement constitutes the entire agreement between you and BOS regarding the use of the BOS Sites and Services. The failure of BOS to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision. The section titles in this Agreement are for convenience only and have no legal or contractual effect. This Agreement operates to the fullest extent permissible by law. If any provision of this Agreement is unlawful, void or unenforceable, that provision is deemed severable from this Agreement and does not affect the validity and enforceability of any remaining provisions.
